Terms & Conditions

At Djleclair Fotografia, we value clarity and professionalism in our engagements. Our Terms and Conditions outline the services we offer, booking and payment procedures, cancellation policies, intellectual property rights, and other essential aspects of our business relationship. We encourage clients to review these terms to ensure a mutual understanding and a seamless experience.

Definitions

“Photographer”: DJLeclair Fotografia, operated by DJ. Leclair.​

“Client”: The individual or entity engaging the Photographer’s services.​

“Services”: Photography services offered by the Photographer, including but not limited to studio portraits.​

Services Provided

The Photographer agrees to provide professional photography services as outlined in the agreed-upon contract or service description. Any additional services or modifications must be agreed upon in writing by both parties.

Booking and Payment Terms

Booking Fee: A non-refundable deposit of [amount or percentage]% is required to secure the booking. This fee will be applied toward the total cost of the services.​

Payment Schedule: The remaining balance is due [number of days] days before the scheduled session.​

Accepted Methods: Payments can be made via [list payment methods, e.g., credit card, e-transfer].​

Cancellation and Rescheduling

Photographer Cancellation: In the unlikely event the Photographer cancels, a full refund will be provided, or the session will be rescheduled at a mutually agreed-upon time.

Client Cancellation: Cancellations made [number of days] days before the session will forfeit the deposit. Cancellations made within [number of days] days of the session may require full payment.​

Intellectual Property Rights

Copyright: The Photographer retains full copyright of all images.​djeclair.ca

Usage License: Clients receive a non-exclusive, non-transferable license to use the images for personal use. This license prohibits alterations, editing, or transferring the images to third parties without the Photographer’s prior written consent. Commercial use requires a separate agreement.​

Model Release

Consent: Clients grant the Photographer permission to use their images for promotional materials, website galleries, and social media.​

Opt-Out: Clients can request in writing that their images not be used for such purposes.​

Limitation of Liability

Performance: The Photographer is not liable for compromised coverage due to causes beyond control, such as weather, accidents, or venue restrictions.​

Damages: In any event, the Photographer’s liability is limited to the amount paid by the Client.​

Force Majeure

The Photographer shall not be liable for any failure to perform, or delay in performance of, any of their obligations under this agreement if such failure or delay is caused by events beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, epidemics, pandemics, governmental actions, or any other event that qualifies as a force majeure event. In such circumstances, the Photographer will notify the Client as soon as practicable and may offer to reschedule the session or provide a refund of any fees paid, excluding the non-refundable deposit.

 

Indemnification

The Client agrees to indemnify and hold harmless the Photographer, their representatives, and assigns from any and all claims, actions, liabilities, damages, or expenses, including reasonable attorney’s fees, arising out of or related to the Client’s use of the photographs, including but not limited to any claims of defamation, invasion of privacy, or infringement of intellectual property rights.

Governing Law

These terms are governed by the laws of the Province of British Columbia, Canada. For international clients, while local laws may apply, Canadian law will prevail in the event of a conflict.

Dispute Resolution

Negotiation: Parties agree to attempt informal resolution before pursuing legal action.

Mediation/Arbitration: If unresolved, disputes will be mediated/arbitrated in British Columbia.

Changes to Terms

The Photographer reserves the right to modify these terms, with changes effective upon posting on the website. Clients will be notified of significant changes via email or website notice.

Acceptance of Terms

By booking services, the Client agrees to these Terms and Conditions.
